Svelte Terms of Service

These Terms of Service apply to orders placed through the Svelte website or directly with Svelte unless otherwise agreed in writing.
By placing an order with Svelte you agree to these Terms of Service.
1. About Svelte

2. Orders and payment
All prices are displayed in Australian dollars.
The product price, delivery charge and total amount payable will be shown before payment.
Payment in full is required before dispatch unless Svelte agrees otherwise in writing.
We accept the payment methods made available at checkout or otherwise approved by Svelte.
An order confirmation, invoice or receipt will be provided for each order. Where an order is treated as GST-free, the invoice will reflect that treatment.
We may contact you if additional information is required to process or deliver an order.
If a product becomes unavailable after payment has been received, we will contact you and offer an appropriate refund or another available option.
We may cancel and refund an order where there has been an obvious pricing or technical error, suspected fraudulent activity or an inability to supply the product. We will notify you if this occurs.
3. Ongoing delivery
Certain Svelte products may be available through ongoing delivery.
Ongoing delivery is optional and must be actively selected by the customer. It is not automatically selected.
By establishing ongoing delivery you authorise Svelte and its payment provider to charge your selected payment method automatically at the delivery frequency you choose.
You may use the available customer account options to:
- change your delivery frequency or quantity
- update your delivery or payment details
- skip an upcoming delivery
- pause ongoing delivery
- cancel ongoing delivery
There are no cancellation fees.
Changes must be completed before the next scheduled billing date to apply to the upcoming order.
Once an ongoing-delivery order has been processed, we may not be able to change or cancel that particular order. Cancelling ongoing delivery will stop future recurring orders but may not stop an order that has already been processed.
Where a material change is proposed to the product, price or delivery arrangement, we will provide notice before the change applies to future orders where required. You may change, pause or cancel ongoing delivery before the change takes effect.

4. NDIS and funded purchases
Svelte may support purchases for self-managed and plan-managed NDIS participants where appropriate to the participant’s circumstances.
Whether a purchase may be claimed or funded depends on the participant’s plan, available funding and individual circumstances.
Svelte does not:
- assess NDIS eligibility
- approve or allocate funding
- determine whether a purchase is claimable
- guarantee reimbursement or payment by the NDIS, a plan manager or another funding body
- replace clinical or professional advice
Self-managed customers generally purchase directly and receive an invoice or receipt for their records.
For plan-managed orders, Svelte may issue an invoice to the nominated plan manager. Payment must be received before dispatch unless Svelte agrees otherwise in writing.
Customers, participants and their representatives remain responsible for confirming that a purchase is appropriate and permitted under the relevant plan or funding arrangement.

5. Shipping and delivery
Svelte currently delivers within Australia only.
Available shipping services, delivery charges and estimated delivery timeframes are explained in our Shipping Policy and will be shown at checkout before payment.
Customers are responsible for providing a complete and accurate delivery address.
Please contact Svelte promptly if delivery information needs to be corrected. Once an order has been processed or dispatched, we may not be able to change the delivery address.
Orders are dispatched in plain discreet outer packaging.
Delivery timeframes are estimates and may be affected by carrier operations, local delivery conditions, weather or other circumstances outside Svelte’s reasonable control.

6. Returns, refunds and exchanges
Returns, refunds, exchanges and first-order protection are handled in accordance with our Return and Refund Policy.
First-order protection is an additional voluntary Svelte benefit. It is separate from the rights and remedies available under the Australian Consumer Law.
Nothing in these Terms of Service or the Return and Refund Policy limits any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
7. Product information and use
Svelte products are disposable pull-up continence underwear designed to provide everyday continence support.
Product suitability may depend on factors including individual output, fit, body shape, comfort preferences and routine.
Customers should review the product description, sizing information and instructions before purchasing and using a product.
Information provided by Svelte is general product information. It does not replace medical advice, clinical assessment or professional continence advice.
Svelte products are not intended to diagnose, treat, cure or prevent any disease.
Where a customer has concerns about continence needs, skin health, mobility, product suitability or a medical condition, they should seek advice from an appropriately qualified health professional.
8. Privacy and personal information
Svelte collects, uses and discloses personal information as described in our Privacy Policy.
Personal information may be used where reasonably necessary to:
- process and deliver orders
- administer ongoing delivery
- process payments
- provide customer support
- manage returns or refunds
- meet legal, accounting or regulatory requirements
- communicate with customers where permitted
Relevant information may be provided to service providers involved in operating the website, processing payments, managing orders or delivering products.

9. Australian Consumer Law
Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.
Where a product does not meet an applicable consumer guarantee, the customer may be entitled to a remedy under the Australian Consumer Law. The remedy will depend on the nature and seriousness of the problem.
To the extent permitted by law, Svelte is not responsible for loss caused by:
- misuse of a product
- failure to follow product instructions
- use outside the product’s stated purpose
- information supplied by the customer that is incomplete or inaccurate
This section does not limit any liability that cannot lawfully be limited or excluded.
10. Promotions
Svelte may offer temporary promotions from time to time.
A promotion may be subject to separate:
- eligibility requirements
- start and end dates
- product or order requirements
- redemption or customer limits
- combination restrictions
- promotional terms
Unless the promotion states otherwise, it cannot be combined with another discount or promotional offer.
Temporary promotions do not permanently change Svelte’s ordinary product pricing, shipping structure or ongoing-delivery pricing.
Promotional terms do not limit any rights available under the Australian Consumer Law.
11. Website content and intellectual property
Unless otherwise stated, content on the Svelte website is owned by or licensed to Svelte Health Pty Ltd.
This includes the Svelte name, branding, written content, product information, photographs, graphics and website materials.
Website content must not be copied, reproduced, republished, modified, distributed or used commercially without prior written permission from Svelte or the relevant rights holder.
Customers may use website content for personal and non-commercial purposes connected with considering or purchasing Svelte products.
12. Changes to these Terms of Service
Svelte may update these Terms of Service to reflect changes to its products, services, business practices or legal obligations.
The current version will be published on the Svelte website with its effective date.
Changes will apply to future transactions from the date the updated terms take effect. They will not remove rights or obligations that arose before that date.
Where a material change affects an existing ongoing-delivery arrangement, Svelte will provide notice where required and customers may change, pause or cancel future orders before the change applies.
13. Governing law
These Terms of Service are governed by the laws of New South Wales and the applicable laws of Australia.
Nothing in this section limits any rights or remedies available under the Australian Consumer Law or another law that applies to the customer.
If any part of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will continue to apply.
